Fairway as a Data Controller is committed to protecting your privacy.

In this respect, this Data Protection Policy Charter defines the type of personal data available to the Firm, the manner in which it collects them, the treatments implemented, with whom it shares them, how it protects them and for what period it keeps them.

Personal data

As part of its activity, the Firm is called upon to process and collect the following personal data:

• Identity and contact information, such as your name, first name, address, personal and professional phone number, personal and professional email, date of birth, marital status, ID number, training and work experience, tax status, title and function ;
• Bank details and other financial data relating to the regulation management and the prevention of fraud;
• Sensitive personal data collected as part of the management of your file or for the defense of your interests ;

The Firm may need to collect personal data to process your request, for the performance of a contract or because of legal provisions. In case of refusal from you, the Firm may not be able to respond to your request or perform the contract we have. In this case, the Firm may have to cancel the commitment or contract with have with you; we will inform you if it happens.

Collecting your personal data

Your personal data are collected when:
• You, or the legal entity that you represent, seek legal advice from our firm;
• You, or the corporation that you represent, offer to provide us with services;
• You interact with a member of the Firm by phone, email, or in writing;
• You apply on the “Join Us” page of our website;
• You attend our events.

Legal basis

The processing of personal data is based on the legal basis:

• The performance of the contract:
production, management, monitoring of customer files
recovery.

• Compliance with legal and regulatory requirements:

  • • the prevention of money laundering and the financing of terrorism and the fight against corruption;
    billing;
  • • accountability

• The legitimate interest of the Firm:

  • • prospecting and managing the relationship with its customers, suppliers and prospects;
  • • organization, registration and invitation to events organized by the Firm.

Recipients of the data

As part of the processing of your requests, the Firm may share your data, in addition to the members of our Firm concerned by your file (lawyers, lawyers, administrative staff), with:
• Jurisdictions and law enforcement authorities;
• Confreres or partners: lawyers, notaries, bailiffs, experts, mediators, arbitrators, consultants, translators, etc …;
• banking institutions;
• Service providers such as our IT outsourcing company, our business software publisher, or our web hosting company.

The protection of your personal data

A number of security measures have been taken by the Firm to protect your personal data and prevent it from being lost, used, disclosed or altered. In accordance with the applicable European regulations, in case of violation of your personal data, you will be notified by the Firm as it is legally required to do.

Transfer of your personal data

The Cabinet do not transfer your personal data outside of the European Union.

Your rights

In accordance with the European General Regulation on the Protection of Personal Data, you have the following rights:
• A right of information on the processing of your data
• A right of access to your data by requesting a copy of the personal data held about you;
• A right of opposition by opposing the processing of your personal data and ask to block, erase or restrict your personal data under certain circumstances.
• A right to data portability by asking the firm to transmit your personal data to another data controller.
• A right of rectification to correct inaccurate data concerning you or to supplement data related to the purpose of the treatment.
• A right to erasure by deleting your personal data when it is no longer needed for the purposes for which it was originally collected or processed.
• You can define the fate of your data after your death by giving instructions on how you want it to be exercised

If you believe that the Firm had failed to fulfit its obligations, you may file a complaint with the CNIL (Commission Nationale Informatique et Libertés – 3 Place Fontenoy – TSA 80715 – 75334 Paris Cedex 07)

Right to withdraw your consent

If you wish to withdraw your consent in whole or in part to the collection, processing and transfer of your personal data, please follow the unsubscribe link on any prospecting or invitation email, or write directly to fairwayavocats@fway.fr.

Retention period of your personal data
The Firms retains personal data only for the time necessary for the operations for which it have collected it and in compliance with the current regulations.
In this respect, customer data is retained for the duration of the contractual relationship plus five years, the duration of the professional civil lability limitation period.
For the purposes of prevention of money laundering and the financing of terrorism, data is retained five years after the end of relations with the Firm.
For accounting purposes, data is retained for 10 years from the end of the financial year. Prospect data is retained for a period of three years from the last registration to an event organized by the firm.
